Order on Petition for Consistency Review
Pursuant to Utah Admin. Code R652-9-200 and Division of Forestry, Fire and State Lands (Division) Policy, a copy of the Record of Decision (ROD) documenting the Division’s cancellation of the Lake Restoration Solutions, Inc. application can be found in the link above. The Record of Decision has been posted publicly along with a notification that was sent to permittees/lessees of record, adjoining permittees/lessees, and adjoining landowners of Division action on adjacent land or land that they may have real property interest in the form of a lease, permit, or easement.
The narrative record of decision serves two purposes. The first is to ensure a complete explication of the facts and standards on which a decision is based, and the second is to give notice to a party of the opportunity for additional review of the Division’s decision by the Executive Director of the Department of Natural Resources, or the courts. Please pay particular attention to the ADMINISTRATIVE APPEALS section in the Record of Decision, and note that petitions for appeal must be received in our office no later than 5:00 pm on November 17, 2022.

Additional Information
In November of 2017, the Division of Forestry, Fire, and State Lands received a nomination for an exchange of lands at Utah Lake. The Division solicited for exchange proposals and received one from Lake Restoration Solutions, Inc., the same entity that made the nomination.
The Division has accepted the application and will move forward with evaluating the proposal. The Division’s acceptance of the application and the evaluation of the proposal in no way constitutes an endorsement of the project, nor a guarantee that an exchange and/or lease will occur.
